TERMS OF SERVICE
Welcome to Sun and Moon Creations. These Terms of Service (“Terms”) govern your use of our services, including consultations, custom wedding signage, and related offerings (collectively, the “Services”). By booking, purchasing, or otherwise engaging with our Services, you agree to be bound by these Terms.
Business Entity
Sun and Moon Creations (“Sun and Moon Creations,” “we,” “our,” or “us”) is a trade name operated under Midnight Fables, LLC, a limited liability company organized under the laws of the State of Ohio. All contracts, invoices, and legal obligations are entered into with Midnight Fables, LLC.
Scope of Agreement
These Terms apply to all clients, customers, and users (“you” or “your”) engaging with Sun and Moon Creations. Please read them carefully, as they outline important rights and responsibilities relating to your order, payment, design process, and final product delivery.
By engaging with our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should not proceed with booking or purchasing from us.
Website Hosting
Our website and online store are hosted through Squarespace, which provides us with the online platform that allows us to display our portfolio, accept bookings, and process payments securely. Your use of our website and any purchases made through it are also subject to Squarespace’s terms, conditions, and privacy practices. See the Squarespace Privacy Policy for more information on how they collect, use, and store personal and payment information.
Client Conduct & Eligibility
Age Requirement
By using our Services, you represent and warrant that you are at least 18 years of age. Minors may not enter into contracts or agreements for services with Sun and Moon Creations / Midnight Fables, LLC.
Prohibited Conduct
Clients agree not to:
Use harmful, threatening, abusive, profane, or harassing language in any communication with Sun and Moon Creations, whether via email, website, phone, social media, or in-person interactions.
Use or transmit any viruses, malware, spyware, or other destructive software on our website, network, or systems.
Engage in any conduct that may interfere with or disrupt our operations or the experience of other clients.
Termination & Refusal of Service
Violation of any of the above terms may result in immediate termination of services at our discretion. We also reserve the right to refuse service to any client for any reason permitted by law, including but not limited to inappropriate conduct, misrepresentation, or failure to comply with our Terms of Service.
Return & Exchange Policy
Because each piece we create is fully customized, all sales are final. We do not accept returns, cancellations, or exchanges on any products.
We take great care to involve you throughout the design process. This includes providing proofs, updates, and opportunities for your review and approval before production begins. By approving these steps, you acknowledge that the final product reflects your confirmed design choices.
Please note that slight variations may occur in the final product. This may include differences in color tones, textures, finishes, wood grain, or acrylic/mirror edges compared to digital proofs or reference images. These natural and technical variations are expected and do not qualify as defects or grounds for return.
Proofing and Approval Policy
Before production begins, we provide digital proofs and/or written confirmations for your review. It is your responsibility to carefully check all details, including:
Spelling, grammar, names, and dates
Colors, fonts, and design layout
Sizes, materials, and other specifications
By providing your written or electronic approval, you confirm that all details are accurate and final. Once approval is given, Sun and Moon Creations / Midnight Fables, LLC is not responsible for any errors or omissions that were present in the approved proof.
No changes can be made after final approval has been submitted. Any requests for revisions after approval may result in additional fees and extended production timelines, at our sole discretion.
Payment Policy
To finalize your order, a non-refundable deposit or retainer (as specified in your invoice) is required. Work on your order will not begin until this payment has been received. The remaining balance is due in full prior to delivery or pickup, unless otherwise agreed in writing.
Accepted Payment Methods
Electronic payments made through Squarespace Payments, which accepts all major credit cards, debit cards, and ACH transfers.
Cash payments, either prior to production or upon receipt of the final product.
We do not accept personal or business checks.

Non-Refundable Payments
All deposits/retainers are non-refundable. Because our products are fully customized, payments made toward your order cannot be refunded once work has begun.
Failure to submit payment in accordance with the agreed-upon timeline may result in cancellation of your order, with forfeiture of any payments already made.
Delivery and Pickup Policy
At this time, we do not offer shipping services. All orders must be arranged for either local pickup or delivery.
Pickup
Orders are available for pickup at our location in [City/Area], Ohio.
Pickup must be scheduled in advance at a mutually agreed-upon time.
Clients are responsible for ensuring safe transport of their items once they leave our possession. We are not liable for any damage that occurs after pickup.
Delivery
Local delivery may be available within a defined service area in Ohio.
Delivery fees may apply and will be communicated prior to scheduling.
It is the client’s responsibility to ensure someone is available to receive the delivery at the scheduled time.
Unclaimed Orders
Orders must be picked up within 14 days of completion unless prior arrangements are made. Unclaimed orders may be subject to storage fees, and after 60 days, we reserve the right to dispose of the items without refund.
Unexpected Events
We will make every reasonable effort to fulfill your order as agreed; however, Sun and Moon Creations / Midnight Fables, LLC shall not be held liable or responsible for any failure or delay in performance caused by circumstances beyond our reasonable control. These circumstances may include, but are not limited to: acts of God, natural disasters, fire, flood, severe weather, illness, accidents, labor disputes, supply shortages, transportation delays, government restrictions, or other unforeseen events.
In the event of such delays, we will communicate with you as soon as reasonably possible to provide updated timelines or alternative arrangements. If fulfillment becomes impossible due to these circumstances, we reserve the right to cancel the order, in which case any payments made beyond non-refundable retainers or costs already incurred will be refunded.
Copyright & Intellectual Property
All content on the Sun and Moon Creations website, including but not limited to text, images, graphics, designs, logos, and digital proofs, is the property of Sun and Moon Creations / Midnight Fables, LLC and is protected under U.S. copyright and intellectual property laws.
Design Ownership
All custom designs, layouts, and artwork created by Sun and Moon Creations remain our intellectual property, even when tailored to your event.
You are granted a personal, non-exclusive, non-transferable license to use the final, physical product(s) for their intended purpose (e.g., display at your wedding or event).
Digital proofs, mock-ups, and drafts provided during the design process are for review purposes only and may not be copied, shared, or reproduced without our prior written consent.
Photography & Portfolio Use
We reserve the right to photograph completed work and use images of our products for marketing, portfolio, and promotional purposes (including on our website, social media, or print materials). We will never share your personal event details beyond what is visible on the signage itself.
Client Materials
If you provide us with content (such as names, dates, quotes, or custom artwork), you confirm that you have the necessary rights or permissions to use that content. You agree to indemnify and hold us harmless from any claims resulting from the use of materials you provide.
